What is Premises Liability?
Premises Liability Law holds landowners liable for the injuries to another that occur on his or her real property. In other words, Premises Liability Law is the body of law that governs the rights and liabilities of a person who is in possession of land or premises and either makes him/her responsible or relieves him/her of liability for the injuries suffered by individuals who are injured on their land or premises.
These injuries often include accidents involving slip and falls, swimming pools, fires, explosions, animal attacks and accidents involving store displays. Premises Liability can also extend to inadequate security and can occur on any type of property. For example, an owner of property can be liable for injuries occuring to another on his land if it occurred in a house, apartment, apartment complex, theater, mall, sports facility, amusement park, government builiding, commercial building and even in an open spaced area. So long as the property is owned by another, premises liabilty law may apply. It should be noted that merely owning real property does not automatically make the owner or occupier of the property liable for injuries to another that occurred on his property. There must be actual negligence on behalf of the property owner.
